Catawba land suits could exceed 27,000 The Associated Press ROCK HILL York County lawyers are marshaling their forces for the expected onslaught of thousands of lawsuits from the Catawba Indians seeking land claims. More than 27,000 individual lawsuits could be filed in August by the tribe against current landowners. The Catawbas want control of 144,000 acres in York and Lancaster counties, which they claim was illegally taken from them in an 1840 treaty with the state that never was ratified by Congress. "It's going to be an extremely difficult situation.

There has never before been anything like it in U.S. history," said Walt Heinsohn, a York County lawyer who is helping to form the legal defense committee. All 70 active practicing lawyers in York County will be involved, he said. The committee is trying to find an orderly and less expensive way to deal with the expected lawsuits with as little impact as possible on the community, the court system and the property owners, Heinsohn said. It hopes to have something in place by July 1, he said.

One of the ideas will be to share the job of drafting the documents needed to defend the case. The lawsuits must be filed by Oct. 19 under the statute of limitations. "We are coordinating with title insurance companies on how to handle all of this," Heinsohn said. "We are not just operating in a vacuum.

We are working with title companies and their counsel and Congressman John Spratt's office and local Bar members." In a meeting with lawyers two weeks ago, Spratt asked the Bar Association, which is the lawyers' trade organization, to offer its services to the impact of the expected lawsuits. "Every time we get together to talk about this, we are awestruck by the enormity of it," Heinsohn said. There will be ethical complications, however, because some lawyers and judges also are expected to be defendants, he said. The Catawbas said they would sue the landowners individually after their attempts to use a class-action suit were turned down by the courts. They are appealing that decision, and if the 4th U.S.

Circuit Court of Appeals reverses the other rulings before Oct. 19, the individual lawsuits would not be necessary. Don Miller of the Native American Rights Fund in Boulder, said a list of potential defendants should be ready by Aug. 3. The documents to file the lawsuits could be ready by Aug.
